1. Agreement to These Terms

These Terms of Service (“Terms”) apply to your use of www.magickcauldron.com (the “Site”) and to purchases, readings and classes from The Magick Cauldron, 2424 Montrose Blvd., Houston, TX 77006 (“we,” “us,” “our”). By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Our Products

We sell spiritual, religious, metaphysical and Renaissance festival goods, including candles, incense, oils, herbs, stones, tarot decks, books, jewelry, clothing and blades.

• Spiritual and metaphysical items are sold for religious, spiritual, ceremonial and decorative use. We make no claim that any item will produce a particular result, and nothing we sell or say is intended to diagnose, treat, cure or prevent any illness or to replace advice from a doctor, lawyer or other professional.
• Herbs, oils and resins are not sold for eating, drinking or applying to skin unless the product label says otherwise. Keep them away from children and pets.
• Candles and incense must never be left burning unattended. Burn them on a heat-safe surface away from anything flammable.
• Blades and weapons are sold only to buyers 18 or older for display, costume and collecting. You are responsible for knowing and following the laws where you live, carry or ship them. We may refuse or cancel any order we believe would break the law.

3. Product Information, Pricing and Availability

We try to describe and photograph every item accurately, but natural products such as stones, herbs and handmade goods vary in color, size and shape. Colors may also look different on your screen. Our store and website share the same inventory, so an item shown online may sell in the store before your order is processed. Prices can change without notice. If an item is out of stock or listed at the wrong price, we will contact you and may cancel the order and refund any payment.

4. Orders and Payment

Your order is an offer to buy. We accept it when we ship the items. Payment is processed by PayPal, and you agree to PayPal’s terms when you pay. Applicable Texas sales tax is added at checkout. We may refuse or cancel any order, including orders that appear fraudulent or that exceed reasonable quantities.

5. Shipping

We ship within the United States and worldwide. Delivery times are estimates and are not guaranteed. For international orders, you are responsible for any customs duties, import taxes and brokerage fees, and for making sure the items are allowed in your country. Please double-check your shipping address. We are not responsible for packages sent to an address you entered incorrectly.

6. Returns, Exchanges and Damaged Items

Please contact us or call 713-523-0069 before sending anything back so we can tell you whether your item qualifies and how to return it.

• Returned items must be unused and in their original condition and packaging.
• For safety and hygiene, we cannot accept returns of opened herbs, oils, incense, resins or bath products; candles that have been lit; earrings; special orders; or gift cards.
• If an item arrives damaged or you received the wrong item, contact us within 7 days of delivery with your order number and a photo, and we will make it right.
• Approved refunds are issued to your original payment method. Original shipping charges are not refundable unless we made the error.

7. Special Orders

We are happy to special-order items we don’t normally stock. Because these items are ordered just for you, special orders may require a deposit or payment in advance and may not be cancelled or returned once ordered. We will confirm the price and terms with you before placing the order.

8. Tarot Readings and Classes

Readings are offered for spiritual guidance, personal reflection and entertainment. They are not a substitute for medical, psychological, legal or financial advice, and you remain responsible for your own decisions. Class dates, times and fees are set by the store and may change. Call the store for the current schedule and our policy on cancellations and rescheduling.

9. Gift Cards

Gift cards can be used toward purchases as stated on the card or in the gift card email. They cannot be exchanged for cash except where required by law. Treat a gift card like cash; we are not responsible for lost or stolen cards or codes.

10. Your Account

If you create an account, you are responsible for keeping your login details private and for activity under your account. Let us know right away if you believe your account has been used without your permission.

11. Site Content

The text, photos, logos and other content on the Site belong to The Magick Cauldron or its suppliers and are protected by copyright and trademark law. You may view and print pages for personal use, but you may not copy, sell or reuse our content without written permission.

12. Acceptable Use

You agree not to misuse the Site, including by attempting to access it without authorization, interfering with its operation, submitting false or fraudulent orders, or posting unlawful or abusive content.

13. Disclaimer of Warranties

The Site and its content are provided “as is.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. Any manufacturer warranty on a product remains in effect.

14. Limitation of Liability

To the fullest extent permitted by law, The Magick Cauldron will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to a purchase will not exceed the amount you paid for that item.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Harris County, Texas.

16. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of the page shows when they last changed. The Terms in effect when you place an order apply to that order.
